These Terms of Use ("Terms") govern your access to and use of the wrytyx website and application (the "Service"), operated by QRSimple inc ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

wrytyx is an AI-assisted writing tool that helps authors draft, organize, and refine long-form written works. Features include AI text generation, editorial analysis, and content organization. The Service relies on third-party AI providers to process your requests.

2. Accounts

You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. Notify us promptly of any unauthorized use.

3. Your content and ownership

You retain all rights to the text, characters, outlines, and other material you create or upload ("Your Content"). We do not claim ownership of Your Content. You grant us a limited license to store, process, and transmit Your Content solely to operate and provide the Service to you, including sending relevant portions to our AI providers to fulfill your requests.

4. AI-generated output

The Service generates text using automated models. AI output may be inaccurate, incomplete, or similar to content generated for other users. You are responsible for reviewing, editing, and verifying any AI-generated output before relying on or publishing it. We make no guarantee that output is original, accurate, or fit for any particular purpose.

5. Acceptable use

You agree not to use the Service to:

• Violate any law or infringe the intellectual property or privacy rights of others;
• Generate content that is unlawful, harassing, defamatory, or that exploits or harms minors;
• Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service;
• Resell or provide the Service to third parties without our written permission.

6. Tokens, payments, and refunds

AI features are paid for using a prepaid token balance ("wallet"). Token packs are purchased through our payment processor, Stripe. Prices are shown at the time of purchase. Except where required by law, purchased token balances are non-refundable once consumed. We may adjust pricing prospectively with notice.

7. Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; material changes will be posted on this page with a revised "Last updated" date. Continued use after changes take effect constitutes acceptance.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, QRSimple inc and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms or use the Service in a way that risks harm to us or others. You remain responsible for exporting Your Content before termination.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in California.
